Wtransnet consulta Lex Transport, le bureau d\u2019avocats charg\u00e9 de r\u00e9soudre les doutes que les utilisateurs de la Bourse envoient au R\u00e9pondeur Juridique.<br \/>\nL\u2019avocate Lorena Jim\u00e9nez nous a r\u00e9pondu que son cabinet d\u2019avocats est arriv\u00e9 \u00e0 la conclusion suivante\u00a0: \u00ab\u00a0Il n\u2019est pas permis de modifier l\u2019information contenue sur le CMR\u00a0\u00bb pour les raisons suivantes\u00a0:<br \/>\nExtrait de la Convention CMR:<\/p>\n<p>La Convention CMR soutient que le contrat de transport est constat\u00e9 par la lettre de voiture, article 4 et sous-entend l\u2019exp\u00e9dition de trois\/quatre exemplaires originaux, qui devront \u00eatre sign\u00e9s par tous les intervenants dans la relation contractuelle. Ces signatures devront \u00eatre faites \u00e0 la main ou \u00eatre remplac\u00e9es (selon la loi de chaque pays) par le cachet de l\u2019entreprise, de sorte qu\u2019il y ait une trace \u00e9crite de l\u2019identit\u00e9 compl\u00e8te des diff\u00e9rentes entreprises \u00e9tant intervenues. Chacun des exemplaires sera remis \u00e0 chacun des intervenants du contrat\u00a0: CHARGEUR\/EXP\u00c9DITEUR, TRANSPORTEUR-CONSIGNATAIRE.<\/p>\n<p>Le contenu de la LETTRE DE VOITURE devra \u00eatre correct dans son int\u00e9gralit\u00e9, de fa\u00e7on \u00e0 ce que toute irr\u00e9gularit\u00e9, contradiction ou falsification pourra engendrer de graves pr\u00e9judices \u00e9conomiques tels que\u00a0:<\/p>\n<p>En Espagne l\u2019absence ou manque de donn\u00e9es obligatoires sur une lettre de voiture pourra \u00eatre sanctionn\u00e9 par les Services du Transports par une amende pouvant\u00a0 atteindre les 1.001\u20ac (article 141.19 LOT). D\u2019autre part s\u2019il y a un changement des donn\u00e9es recueillies dans la lettre de voiture dans le but de falsifier son contenu, l\u2019amende ou sanction pourra alors atteindre les 4.601\u20ac (article 140.14 LOT)<\/p>\n<p>En France cela peut \u00eatre consid\u00e9r\u00e9 comme un d\u00e9lit avec une peine de prison d\u2019un an et 3.000\u20ac de sanction. Cette responsabilit\u00e9, selon le pays, pourra \u00eatre incomb\u00e9e au CHARGEUR, au TRANSPORTEUR, aux deux en m\u00eame temps ou m\u00eame au CHAUFFEUR. De plus, sans pr\u00e9judice de ce qui pr\u00e9c\u00e8de, le CMR indique express\u00e9ment dans sa convention que le CHARGEUR, ainsi que le TRANSPORTEUR, seront responsables des frais et pr\u00e9judices r\u00e9sultant de l\u2019inexactitude ou insuffisance des donn\u00e9es qu\u2019ils devront ajouter \u00e0 la lettre de voiture (11.3 CMR).
